Subic alleged that just before midnight of November 1, 2005, Lance Corporal Daniel Smith raped her inside a moving Starex van at Alava Pier in Subic. Initially she claimed she was GANG RAPED by Smith and his honchos but changed THAT statement after a few days (why? because she didn't have enough evidence to extort THEIR money as well??), "Nicole also alleged that Smith's other companions, Lance Corporals Keith Silkwood and Dominic Duplantis and Staff Sergeant Chad Carpentier, were inside the van cheering Smith on as the incident happened."
